Terms of Service
Fort Myers Junk Removal, LLC
Effective Date: October 18, 2026 | Last Updated: October 18, 2026
PLEASE READ THESE TERMS CAREFULLY. They govern your use of FtMyersJunkRemoval.com and, when incorporated into an estimate, work order, invoice, payment request, or other service agreement, the junk removal and related services provided by Fort Myers Junk Removal, LLC. Certain provisions affect legal rights and allocate responsibility between the parties.
These Terms of Service (the “Terms”) are entered into between Fort Myers Junk Removal, LLC (“Fort Myers Junk Removal,” “Company,” “we,” “us,” or “our”) and the person or entity using our Website, requesting an estimate, authorizing work, making a payment, or receiving services (“Customer,” “you,” or “your”). Our business is straightforward: customers ask us to remove unwanted property, we evaluate the work, provide an estimate or pricing information, and coordinate the labor, transportation, disposal, recycling, donation, or other resources reasonably necessary to complete the job. These Terms establish the rules that make that process clear for both sides.
1. Acceptance of These Terms
By accessing or using FtMyersJunkRemoval.com (the “Website”), requesting or accepting an estimate, paying a deposit, authorizing us to begin work, signing or electronically accepting a work order, or otherwise engaging Fort Myers Junk Removal to provide services, you agree to these Terms to the extent applicable to that interaction.
If you act for a business, estate, trust, property owner, landlord, association, governmental body, or another person or entity, you represent that you have authority to bind that person or entity. If a written estimate, work order, proposal, invoice, or separately signed agreement directly conflicts with these Terms, the more specific written term governing that job controls to the extent of the conflict.
2. Our Services
Fort Myers Junk Removal provides junk removal, hauling, cleanouts, property cleanout services, selected light removal or dismantling work, and related services that we agree to perform. The exact scope is determined by the estimate, work order, written communications, photographs, on-site conditions, and approved changes.
We do not undertake work merely because a service or item is mentioned on the Website. We may decline work that is unsafe, unlawful, outside our capabilities, materially different from what was represented, or otherwise inappropriate for our personnel, equipment, contractors, or business.
3. Estimates, Photographs, and Pricing
We frequently prepare estimates from photographs, videos, descriptions, measurements, item counts, or other information supplied by the Customer. Unless expressly identified as a fixed-price quote, an estimate is based on information reasonably available when prepared.
Pricing may change when the actual job differs materially from the information provided or conditions visible in submitted photographs. Examples include greater volume or weight, hidden items, difficult access, undisclosed stairs or elevators, long carries, restricted parking, disassembly, hazardous or regulated materials, dense debris, additional labor, special equipment, or unexpected disposal charges. If a material pricing change is identified, we will seek to communicate it and obtain authorization before materially expanding the work whenever reasonably practicable.
4. Deposits, Payment, and Authorization to Proceed
We may require a deposit or advance payment to reserve a service date, commit labor or equipment, or authorize work. The amount and timing will be stated in the applicable estimate, payment request, or job communication. Unless otherwise agreed in writing, the remaining balance is due upon completion of the agreed work.
Customer authorizes us and our payment providers to process amounts the Customer affirmatively approves. A deposit does not require us to perform work that is unsafe, unlawful, materially misrepresented, or outside the agreed scope.
5. Scheduling and Arrival Windows
Service dates and arrival windows are good-faith scheduling commitments, not guarantees of an exact arrival minute unless expressly agreed in writing. Junk removal is field work. Traffic, disposal-facility delays, weather, job conditions, equipment issues, earlier jobs, staffing changes, emergencies, and other circumstances can affect timing. We will make reasonable efforts to communicate significant delays.
6. How We Staff Jobs: Employees, Independent Contractors, and Subcontractors
Fort Myers Junk Removal operates in a busy, service-driven market. Demand can vary substantially by day, season, location, job size, and type of work. To serve customers efficiently, maintain scheduling flexibility, and match appropriate labor and equipment to a project, we may perform services through our own personnel or engage qualified third parties to perform some or all field work.
The people who arrive at a property may therefore include employees of Fort Myers Junk Removal, independent contractors, subcontractors, hauling operators, drivers, specialty service providers, or personnel working for an independent service company engaged by us. Customer authorizes Fort Myers Junk Removal to select and coordinate such personnel when we determine that doing so is appropriate for the job.
Using a subcontractor or independent service provider does not change the Customer’s agreed price merely because a third party performs part of the work, unless the scope changes and the Customer approves an adjustment. Fort Myers Junk Removal remains the Customer’s primary point of contact for services contracted through us, except where we expressly disclose that the Customer is entering a separate agreement directly with another provider.
Third-party providers may use their own vehicles, tools, equipment, methods, and personnel and may be independent businesses rather than employees of Fort Myers Junk Removal. Nothing in these Terms creates an employment relationship where none otherwise exists. We expect providers performing work through us to act professionally and perform the assigned scope with reasonable care. If a concern arises, Customer should notify Fort Myers Junk Removal promptly so we have a reasonable opportunity to investigate and address it.
7. Customer Responsibilities and Accurate Job Information
Customer agrees to provide reasonably accurate and complete information, including the nature and quantity of materials, access conditions, stairs, elevators, gates, parking restrictions, building rules, known hazards, unusually heavy items, and other facts that could materially affect safety, labor, equipment, timing, or disposal.
Customer is responsible for obtaining permission necessary for us to enter the property and remove identified items, including permission from an owner, landlord, association, property manager, estate representative, tenant, or other person with legal control.
8. Authority to Remove Property
By identifying property for removal or authorizing work, Customer represents that Customer owns the property, has lawful authority to dispose of it, or has permission from the person with such authority. We may reasonably rely on Customer’s directions regarding what is to be removed.
Customer is responsible for clearly identifying items that must remain. We strongly recommend separating or removing valuables, documents, medications, firearms, cash, jewelry, heirlooms, keys, and electronic devices containing important data before work begins. If ownership or authority is disputed, we may suspend or terminate work until the dispute is resolved to our reasonable satisfaction.
9. Property Access and Site Conditions
Customer will provide reasonably safe and lawful access and disclose known conditions affecting safety or performance, including unstable structures, pests, mold, biological hazards, sharp objects, unsafe flooring, aggressive animals, blocked exits, utilities, and concealed conditions. We may stop work if conditions appear unsafe or materially different from those disclosed.
10. Items We May Refuse to Handle
We may refuse material we reasonably believe is hazardous, illegal, unsafe to transport, prohibited by a disposal facility, outside our insurance or operational capabilities, or outside the agreed scope. Examples may include explosives, ammunition, certain chemicals, biohazardous waste, asbestos-containing materials, radioactive materials, regulated medical waste, controlled substances, and unknown liquids or powders. This list is illustrative, not exhaustive.
11. Heavy, Bulky, and Difficult-to-Access Items
Customer should disclose unusually heavy, oversized, built-in, elevated, or difficult-to-access items. Pianos, safes, hot tubs, large appliances, exercise equipment, boats, machinery, construction debris, and similar items may require additional labor, equipment, dismantling, or specialty handling. We may decline to move an item if doing so would create an unacceptable risk of injury or property damage.
12. Removal, Disposal, Recycling, Donation, and Salvage
Once property is lawfully removed from the Customer’s premises and accepted into our custody for disposal, recycling, donation, salvage, transfer, reuse, or other disposition, Customer relinquishes ownership and control of that property except as otherwise agreed in writing or required by law.
We may determine the appropriate lawful disposition of removed property and may use transfer stations, landfills, recyclers, donation organizations, reuse channels, salvage outlets, or other lawful destinations. We do not guarantee that a particular item will be donated, recycled, resold, or diverted from a landfill unless expressly agreed in writing. Statements that we attempt to donate or recycle usable materials describe an operational goal, not a guarantee that a third party will accept an item.
13. Before-and-After Documentation
We or our service providers may photograph or otherwise document work areas before, during, and after service for estimating, dispatch, job verification, quality control, payment, insurance, safety, dispute resolution, and business-record purposes. Internal documentation does not itself authorize public advertising use where separate permission is required. Personal information is also governed by our Privacy Policy.
14. Customer Presence and Unattended Service
If Customer authorizes work while not present, Customer remains responsible for lawful access, clear removal instructions, and a reliable means of communication. We may rely on written instructions, photographs, markings, messages, or directions from an authorized on-site representative. We may decline unattended service where scope, ownership, access, or removal instructions are insufficiently clear.
15. Changes to Scope and Additional Work
Requests to remove additional items, enter additional areas, perform additional dismantling, wait for access, make an additional trip, or perform work outside the original scope may result in additional charges. Approval may be documented through a signed work order, electronic acceptance, text message, email, payment, or other conduct reasonably demonstrating agreement to the revised scope.
16. Cancellations and Rescheduling
Unless a job-specific estimate or agreement states otherwise, Fort Myers Junk Removal does not impose a general cancellation fee merely because a Customer decides not to proceed before resources have been materially committed. We ask Customers to provide as much notice as reasonably possible.
For unusually large, remote, specialty, labor-intensive, or equipment-dependent projects, we may disclose job-specific cancellation, mobilization, or nonrefundable deposit terms before the Customer commits. Those specific written terms control for that job. We may reschedule or cancel work because of unsafe conditions, severe weather, equipment failure, staffing emergencies, legal restrictions, inaccurate job information, nonpayment, or circumstances outside our reasonable control.
17. Completion and Customer Inspection
Customer should inspect the work promptly upon completion when reasonably possible and notify us of any material concern before the service team leaves or as soon thereafter as reasonably practicable. Prompt notice gives us an opportunity to inspect the condition, preserve evidence, communicate with personnel involved, and, where appropriate, offer a practical correction.
18. Pre-Existing Conditions and Ordinary Risks of Removal Work
Junk removal necessarily involves carrying bulky items through homes, garages, yards, stairways, doors, elevators, parking areas, and confined spaces. Customer acknowledges that reasonable performance can involve ordinary risks to walls, floors, doors, trim, landscaping, driveways, elevators, and surrounding property, particularly where access is narrow, surfaces are fragile, or items are oversized.
We are not responsible for pre-existing damage, concealed defects, ordinary wear, deterioration, improperly installed fixtures, unstable structures, or damage caused primarily by a condition that was not reasonably visible or disclosed. Nothing in this section excuses liability that cannot lawfully be limited.
19. Claims for Property Damage or Service Concerns
If Customer believes our work caused property damage or a material service deficiency, Customer should notify us promptly at legal@ftmyersjunkremoval.com or through the contact method used for the job and provide reasonable supporting information, including photographs when available.
Customer agrees to provide us a reasonable opportunity to inspect alleged damage before permanent repairs are made, except where emergency mitigation is reasonably necessary to prevent additional damage or protect safety. We may investigate using photographs, communications, job records, statements from personnel or service providers, and other relevant information. Nothing in this section waives a claim or defense that cannot lawfully be waived.
20. No Guarantee of Disposal Value or Tax Benefit
Fort Myers Junk Removal does not appraise removed property and does not provide tax, accounting, or legal advice. We make no representation regarding resale value, donation value, tax deductibility, or tax treatment. If a third-party charity independently provides donation documentation, that organization is responsible for its documentation and acceptance criteria.
21. Chargebacks and Payment Disputes
If Customer disputes a charge, we encourage Customer to contact us first so we can investigate and attempt to resolve the issue efficiently. Initiating a chargeback does not eliminate a valid payment obligation for services actually authorized and performed.
We may provide estimates, photographs, messages, invoices, authorization records, completion documentation, and other relevant business records to payment processors, financial institutions, insurers, or other parties involved in resolving a payment dispute. We will not knowingly submit false or misleading information.
22. Website Use
The Website explains our services, service areas, process, pricing approach, and related information and allows visitors to contact us or request estimates. You may use it only for lawful purposes. You may not interfere with its operation or security; attempt unauthorized access; introduce malware; scrape or extract content at unreasonable scale; impersonate another person; submit fraudulent requests; or violate law or the rights of others.
23. Website Information Is Not a Binding Quote
General pricing examples, service descriptions, photographs, load illustrations, service-area descriptions, educational content, and other Website information are general information unless expressly incorporated into a specific written estimate or agreement. Actual price and availability depend on the particular job.
24. Intellectual Property
The Website and its original text, design, graphics, logos, photographs, layout, software, databases, and other content are owned by or licensed to Fort Myers Junk Removal and protected by applicable law. You may use the Website for ordinary purposes related to evaluating or purchasing our services, but may not reproduce, republish, sell, systematically copy, create a competing database from, or commercially exploit substantial portions of our proprietary content without written permission, except as permitted by law.
25. Third-Party Websites and Services
The Website or our service process may use or link to independent platforms for maps, reviews, payments, communications, analytics, scheduling, or other functionality. We do not control independent third-party services, and their terms and privacy practices may apply when you interact directly with them. A link or integration is not a warranty of every aspect of that service.
26. Privacy
Our collection and handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference to the extent applicable.
27. Communications and Electronic Transactions
Customer agrees that estimates, approvals, work orders, invoices, notices, photographs, and other transaction records may be created, sent, received, stored, and accepted electronically where permitted by law. An electronic acceptance, electronic signature, text-message approval, email approval, payment of a requested deposit, or other affirmative electronic action may evidence agreement when the context reasonably demonstrates intent.
28. Disclaimer of Website Warranties
THE WEBSITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES RELATING TO THE WEBSITE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Website will be uninterrupted, error-free, immune from malicious activity, or that every piece of Website information will remain current at all times. This disclaimer does not eliminate warranties or rights that cannot lawfully be disclaimed.
29. Service Standard; No Implied Guarantee Beyond the Agreed Scope
We intend to perform or coordinate agreed services in a professional manner consistent with the nature of the work. Except for express commitments in a specific written agreement and rights that cannot lawfully be disclaimed, we do not make additional warranties regarding a particular outcome, resale or donation result, disposal destination, completion time, or condition beyond the agreed scope.
30. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER FORT MYERS JUNK REMOVAL NOR ITS OWNERS, OFFICERS, EMPLOYEES, OR AGENTS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF USE, OR LOSS OF DATA, ARISING FROM THE WEBSITE OR SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES MAY BE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM A PARTICULAR SERVICE TRANSACTION WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO FORT MYERS JUNK REMOVAL FOR THE PARTICULAR SERVICES GIVING RISE TO THE CLAIM, EXCEPT TO THE EXTENT A DIFFERENT REMEDY OR LIMITATION IS REQUIRED BY LAW.
These limitations do not apply to liability that cannot lawfully be excluded or limited. Nothing in these Terms is intended to limit responsibility for intentional misconduct, fraud, or any other liability to the extent applicable law prohibits limitation.
31. Indemnification for Customer-Caused Claims
To the extent permitted by law, Customer agrees to defend, indemnify, and hold harmless Fort Myers Junk Removal and its owners, officers, employees, and agents from third-party claims, damages, liabilities, costs, and reasonable attorneys’ fees arising from Customer’s material breach of these Terms; Customer’s lack of authority to dispose of property; Customer’s unlawful instructions; or hazardous conditions or materials knowingly concealed or materially misrepresented by Customer.
This provision does not require Customer to indemnify a party for that party’s own conduct to the extent such indemnification is prohibited by applicable law.
32. Insurance and Third-Party Claims
Where an incident may implicate insurance, we may provide relevant job records and cooperate reasonably with insurers, claims administrators, contractors, or other parties investigating the matter. Nothing in these Terms guarantees insurance coverage for any particular event or loss.
33. Force Majeure and Events Outside Reasonable Control
We are not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, hurricanes, flooding, fire, government orders, road closures, disposal-facility closures, labor disruptions, utility or telecommunications failures, widespread equipment shortages, civil emergencies, or similar events. We will use commercially reasonable efforts to resume affected services when practicable.
34. Resolving Disputes in Good Faith
Before filing a lawsuit concerning a service transaction, the parties agree to make a good-faith effort to resolve the dispute directly. A party asserting a claim should provide reasonable written notice describing the issue and requested resolution and allow the other party a reasonable opportunity to respond.
This informal process does not prevent either party from seeking emergency injunctive relief, preserving a claim before a limitations period expires, pursuing an available small-claims remedy, or exercising a right that cannot lawfully be conditioned on pre-suit negotiation.
35. Governing Law and Venue
These Terms and disputes arising from them are governed by the laws of the State of Florida, without regard to conflict-of-laws principles, except where federal law or another mandatory law controls.
Subject to any non-waivable right or jurisdictional requirement, any judicial proceeding arising primarily from services performed in Lee County, Florida, or from these Terms shall be brought in a court of competent jurisdiction in Lee County, Florida, or the applicable federal court serving that area. Nothing in this provision prevents a matter from being filed in another forum when applicable law requires or permits a non-waivable forum.
36. No Waiver of Non-Waivable Consumer Rights
These Terms are intended to allocate commercial responsibilities, not eliminate rights that the law does not permit a business or consumer to waive. If a consumer-protection law, licensing rule, statute, regulation, or court order grants a right or remedy that cannot lawfully be waived, that right or remedy remains available notwithstanding these Terms.
37. No Third-Party Beneficiaries
Except where these Terms expressly protect an owner, officer, employee, agent, or other identified person, these Terms are for the benefit of the parties and do not create enforceable rights in unrelated third parties.
38. Assignment
Customer may not assign a service agreement in a manner that materially changes our obligations without our written consent. We may assign these Terms or a service agreement in connection with a merger, reorganization, financing, sale of substantially all relevant assets, or transfer of the business, subject to applicable law.
39. Severability
If a court of competent jurisdiction determines that a provision of these Terms is invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will remain in effect.
40. No Waiver
A party’s failure to enforce a provision on one occasion does not waive the right to enforce that provision later. A waiver must be clear and applies only to the specific matter for which it is given.
41. Entire Agreement for the Applicable Transaction
These Terms, together with the applicable estimate, work order, invoice, approved change, Privacy Policy, and any other document expressly incorporated into the transaction, constitute the agreement concerning that transaction and supersede prior statements concerning the same subject to the extent they conflict.
Oral statements do not modify a written job term unless the modification is later confirmed in writing or otherwise established by conduct sufficient to create an enforceable modification under applicable law.
42. Changes to These Terms
We may revise these Terms from time to time to reflect changes in our business, technology, services, or legal requirements. The “Last Updated” date identifies the current published version. Changes apply prospectively unless applicable law or a separate agreement permits otherwise. The Terms in effect when a particular service transaction is accepted generally govern that transaction unless the parties agree to a later modification.
43. Contact and Legal Notices
Questions about these Terms or formal notices concerning a service dispute may be directed to:

Please include enough information for us to identify the relevant estimate, job, invoice, or communication. Do not send Social Security numbers, complete payment-card numbers, passwords, or other sensitive credentials by ordinary email.
44. A Practical Word About These Terms
These Terms are intended to make expectations clear before a problem occurs. Most jobs are simple: we agree on what needs to go, confirm the price, show up, remove it, document completion, and get paid. The provisions above exist for the situations that are less simple - unusual access, hidden hazards, disputed ownership, changing scope, third-party crews, property claims, payment disputes, or circumstances nobody reasonably expected.
Our goal is not to use these Terms as a substitute for fair dealing. It is to establish a clear operating framework so customers, Fort Myers Junk Removal, and the people performing the work understand their responsibilities from the beginning.
